Clarification - An article published in the July 7 issue of The Journal concerning Tier Two reporting inaccurately stated that Tier Two requirements relate to business or industries which use, manufacture or handle hazardous materials.
The article should have stated: “It (Tier Two requirements) says that certain businesses or industries or other commercial entities which use or manufacture or store hazardous materials in amounts , and at levels, beyond a certain threshold, must report those conditions to appropropriate authorities.”
The article reported accurately that “Tier Two Reporting records at the county emergency planning department, reflect no contribution by either the Lincoln Oil Co., which imports and blends the ethanol, nor by the Greenville & Western Railroad, LLC which transports the ethanol in railroad tanker cars.
However, as a transporter, the Greenville & Western Railroad is not required to report to the county under the Tier Two requirements.
The Journal did not mean to imply that the G&W Railroad was out of compliance with applicable state and federal law concerning EPCRA reporting requirements, only that there was no record of contribution made by either party associated with the transport and storage of a hazardous material (ethanol) with Anderson County.
