PETITION TO
REOPEN ESTATES
The Petitioner would show unto this Honorable
Court as follows:
Clarence Thomas died testate October 14, 1974
(see PJ87ES0403181) leaving Carrie Thomas, his wife, a life estate in
all property owned by him at the time of his death, including the
property hereinafter described with the remainder interest in said
property at Carries death to his five daughters, to wit, Azalee
T. Sloan, Mable T. James, Carrie L. Thomas Owens, Macie T. Sadler and
Estella T. Roberts. Carrie Thomas died testate on March 16, 1987 (see
PJR01187ES0400245) leaving her property on Pruitt Street (the
property hereinafter described) to Macie T. Sadler for life only,
then to Marcia A. Thomas, her granddaughter.
On July 28, 2007, Marcie A. Thomas deeded all
of her right, title and interest in the property on Pruitt Street
hereinafter described to Macie T. Sadler. Said deed was recorded in
the Office of the Register of Deeds for Anderson County, South
Carolina on August 20, 2007 in Book 8203 at Page 0040.
Also, on July 28, 2007, Mable T. James
deeded all of her right, title and interest in the property on Pruitt
Street hereinafter described to Macie T. Sadler. Said deed was
recorded in the Office of the Register of Deeds for Anderson County,
South Carolina on August 20, 2007 in Book 8203 at Page 0035.
The only heirs left with any interest in the
property hereinafter described on Pruitt Street other than Macie T.
Sadler are Azalee T. Sloan, Carrie L. Thomas Owens, Estella T.
Roberts and Mable T. James.
The Petitioner, Macie T. Sadler, has, since
the death of Carrie Thomas on March 16, 1987, paid all insurance
premiums for homeowners insurance on the said property and has paid
all county taxes on said property.
The Petitioner, Macie T. Sadler, is,
therefore, informed and believes that she is entitled to
reimbursement for the payment of the aforesaid taxes and the
insurance premiums on said property as a creditor of Clarence Thomas
and Carrie A. Thomas and petitions the Court to reopen the Estate of
Carrie A. Thomas and to reopen the Estate of Clarence Thomas and that
she be allowed to offer the property hereinafter described for sale
in aid of assets of both estates in a private or public sale and that
from the proceeds from said sale she be reimbursed for the payment of
the aforesaid taxes and insurance.
The property subject to this action is as follows:
TMS# 150-02-12-003
ALL that certain lot or parcel of land, with
the buildings thereon, situate within the corporate limits of the
City of Anderson, County of Anderson, and State of South Carolina,
lying at the corner of Pruitt Street and Alexander Street fronting on
Pruitt Street fifty (50) feet, more or less, and running back one
hundred and thirty seven (137) feet more or less, in the form of a
parallelogram, and being known as lot Number Four (4) in Section
A as shown on a plat of record in the Office of the
Register of Deeds for Anderson County, South Carolina in Deed Book 3
W, at Page 525, being bounded on the North by lands now or formerly
of James Dupre, on the East by Alexander Street, on the South by
Pruitt Street, and on the West by lands now or formerly of Gassaway
and Earle.
This is the same property conveyed to Clarence
Thomas and Carrie Thomas by deed of Prue W. Sherard dated November 3,
1954 and recorded in the Office of the Register of Deeds for Anderson
County, South
Carolina on November 3, 1954 in Deed Book 9W
at Page 544.
Petitioner agrees that Azalee T. Sloan, Carrie
L. Thomas Owens, Estella T. Roberts and Mable T. James or their
living heirs shall be served notice of this Petition to Reopen the
Estates of Carrie A. Thomas and Clarence Thomas and to allow her to
sell the property herein before described in aid of assets.
Wherefore, Petitioner prays as follows:
1. That as the Personal Representative of the
Estate of Carrie A. Thomas, she be allowed to reopen Carrie A.
Thomas Estate.
2. That she be allowed to reopen the Estate of
Clarence Thomas and serve as personal representative of the Estate.
3. That after the Estate of Carrie A. Thomas
is reopened, that Macie T. Sadler, as Personal Representative of the
Estate of Carrie A. Thomas, be alowed to sell the property herein
before described in aid of assets and to apply the proceeds from the
sale of said property by private or public sale to the amounts owed
Macie T. Sadler for payment of insurance premiums and taxes on the
aforesaid property since the death of Carrie A. Thomas.
